Agreeing to the terms of this waiver as the ticket purchaser or parent/guardian is required to participate in this event. When signing this waiver, the signee, also known as "participant" as indicated below, acknowledges that they have shared this waiver agreement with their group members, and that they agree to the terms for both themself, the "participant," and all attendees in their "group."

ASSUMPTION OF RISK, RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT PARTICIPANT & GROUP WAIVER

Event: Enchanted shall hereafter be known as (the “Event”)
Event Date(s): October 21, 2023. Rain Date October 22, 2023.

Participant: The signing attendee shall hereafter be known as (the “Participant”).

Group: The members of the signing attendee’s group, also known as additional ticket holders. Attendees for whom the Participant purchased tickets for shall hereafter be known as (collectively, “Group”).

Releasees: Arts Council of Glen Rock, 501(c)(3) 1 Harding Plaza, Glen Rock, NJ 07452, the Borough of Glen Rock 1 Harding Plaza 07452, Glen Rock, NJ, Enchanted and its member institutions, or any subdivision thereof, and each of them, their officers, volunteers, and employees, (collectively, the “Releasees”).

In consideration of permission granted by Releasees permitting Participant and Group to participate in the Event, I represent, covenant and agree, on behalf of myself, the Group, and my heirs, assigns, and any other person claiming by, under or through me, as follows:

Assumption of Risk: The Participant hereby acknowledges and agrees that they understand the nature of the Event; that Participant and Group are qualified, in good health, and in proper physical condition to participate therein; that there are certain inherent risks and dangers associated with the Event including possible exposure to or infection from the coronavirus; and that, except as expressly set forth herein, they, knowingly and voluntarily, accept, and assume responsibility for each of these risks and dangers, and all other risks and dangers that could arise out of, or occur during, Participant and Group’s participation in the Event that could cause injury, illness, damage, disease, disability, or death (collectively, “Harm”). Participant and Group understand that the risk of Harm may or may not result from the actions, omissions, or negligence of themselves and others including, but not limited to, “Releasees.” Participant and Group accept sole responsibility for any Harm that they may suffer or incur as a result of, or in any way related to attendance at the Event.

Release and Waiver: The Participant and Group hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE the the Arts Council of Glen Rock, 501(c)(3) 1 Harding Plaza, Glen Rock, NJ 07452, the Borough of Glen Rock 1 Harding Plaza 07452, Glen Rock, NJ, Enchanted and its member institutions, or any subdivision thereof, and each of them, their officers and employees, (collectively, the “Releasees”), from and for any liability resulting from any personal injury, accident or illness (including death), and/or property loss, however caused, arising from, or in any way related to, Participant and Group’s participation in the Event.

Indemnification and Hold Harmless: The Participant and Group also hereby agree to INDEMNIFY, DEFEND AND HOLD the Releasees HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities including, but not limited to, attorney’s fees, arising from, or in any way related to, Participant and Group’s participation in the Event including the acts or omissions from any guest, participant, visitor, or other person attending the Event herein referred to.

Permission to Use Likeness: Participant and Group hereby grant Arts Council of Glen Rock and Enchanted permission to use my likeness in a photograph, video or other digital media in any and all of its publications, including web-based publications and marketing without payment or other consideration.

Rules and Regulations: The Participant and Group agree to adhere to the rules of Enchanted and abide by all Borough of Glen Rock rules, regulations, and policies. Participant and Group understand that tickets are non-refundable. The Event organizers reserve the right to ask Participant or Group to leave if Participant or Group are not abiding by the rules and regulations, or are behaving in a manner deemed unsafe, offensive, or inappropriate for young children and families.

Severability: The Participant and Group expressly agree that the foregoing assumption of risk, release and waiver of liability and indemnity agreement is intended to be as broad and inclusive as is permitted by the law of the State of New Jersey and that if any portion thereof is held invalid, it is agreed that the balance shall, notwithstanding, continue in full legal force and effect.

Acknowledgment of Understanding: The Participant and Group have read this assumption of risk, release and waiver of liability and indemnity agreement, and have had the opportunity to ask questions about the same. The Participant and Group fully understand this assumption of risk, release and waiver of liability and indemnity agreement, that the Participant and Group are giving up rights in connection therewith, and that its terms are contractual, and not a mere recital. The Participant and Group acknowledge that they are agreeing to this contract freely and voluntarily. Participant acknowledges that they have shared the terms of this waiver with any and all members of the Group, and understands that agreeing to the terms of this document counts as acknowledgment and acceptance on behalf of themself, the “Participant,” and the members of their group, the “Group.”
